In simple terms it gives the Company the opportunity to rehabilitate itself under the temporary supervision of a suitably qualified Business Rescue Practitioner.
- The Board of Directors pass a Resolution to apply for Business Rescue, or a creditor may apply to the High Court.
- A Business Rescue Practitioner is appointed.
- The Business Rescue Practitioner in reality will become the CEO of the Company for the duration.
- Subject to stringent time periods (see below) laid out in The Act the Business Rescue Practitioner will meet with creditors, investigate the affairs of the Company and prepare a Business Rescue Plan. This may include a re-organisation and restructure of the Company as a whole.
- The preferred objective of the Business Rescue Plan is to create an environment in which the Company may continue trading and will in time be able to repay it's debts. If not, then at least put in place a Business Rescue Plan where the creditors and shareholders will receive a better return than if a Business Rescue Plan was not implemented, or the Company was placed into liquidation immediately.
